TREC Rule Update: Authorization to Advertise
The Tennessee Real Estate Commission (TREC) proposed a rule change last fall. Tennessee REALTORS® voted to support. The rule recently received a positive recommendation from the Joint Government Operations Committee and will take effect April 22.
Advertising listings of another licensee; required permission:
- Currently, TREC rules require written authorization from the property owner when a licensee wishes to advertise property listed by another licensee.
- TREC’s update will change permission from property owner to permission from the listing agent or listing broker.
- If a licensee wants to share the listing of another licensee on social media, for instance, they would need to contact the listing agent and obtain written permission from the agent.
- This rule is more aligned with today’s real estate practices.
Effective April 22, the new rule will read:
Rule 1260-02-.12: (3)(e) No licensee shall advertise property listed by another licensee without written authorization from the listing agent or listing broker.
