Advertising Rule Changes
In previous editions of The Digest we have answered questions regarding changes to the Tennessee Real Estate Commission’s (TREC) Advertising Rule. This week we build on those to address how rule changes apply to your business…
Include My Office’s Phone Number in Ads?
Q: Based on the new advertising rules, does an advertisement need to include my office phone number?
A:Yes, the new advertising rule still requires placement of the firm phone number. However, it no longer requires that the firm phone number be the same size or larger as the licensee’s. TREC Rule 1260-02.12, Advertising includes:
(3)(b) All advertising shall be under the direct supervision of the principal broker and shall list the firm name and the firm telephone number as listed on file with the Commission…
Size of Broker’s Name on Signs?
Q: Is it okay if my name, as affiliate broker, is larger than the firm’s name on my real estate signs?
A:No, section (3)(b) of the new Advertising Rule clearly indicates that the firm name must appear in letters the same size or larger than those spelling out the name of a licensee or the name of any team, group, or similar entity.
Name/Phone Number on EVERY Social Media Post?
Q: Is it necessary to include our firm name, firm phone number, etc., on every single Facebook post?
A:Per TREC’s recently adopted Advertising Rule, having this information accessible in one click is sufficient. It does not need to appear on every social-media post but does need to be readily available. Rule 1260-02.12:
(6) Social Media Advertising
(a) For the purpose of this rule, “social media” means internet-based applications or platforms that allow the public to create and share content and information. Examples include, but are not limited to: Facebook, Twitter, lnstagram and Linkedln.
(b) With regards to social media advertising by licensees, the firm name and firm telephone number listed on file with the Commission must be no more than one click away from the viewable page.
(c) Listing information must be kept current and accurate. This requirement shall apply to “First Generation” advertising as it is placed by the licensee and does not refer to such advertising that may be syndicated or aggregated advertising of the original by third parties outside of the licensee’s control and ability to monitor.
